You May Be Eligible for a Share of the $10.5 Million Settlement in the Spam Email Case.

Unwanted text messages are annoying, especially when they continue to appear from a legitimate sender even after you’ve opted out. If you’ve received spam messages from Kaiser Permanente, you may be eligible for a cash settlement for each message.
A healthcare company serving over 12.5 million people recently settled a $10.5 million class-action lawsuit over marketing text messages sent after recipients attempted to opt out. The lawsuit, filed in August 2025, alleged that Kaiser Permanente failed to honor opt-out requests. Those with a valid claim can receive up to $75 for each qualifying text message.
Are you eligible for compensation from Kaiser?
To receive payment under this agreement, you must have received more than one text message from Kaiser Foundation Health Plan Inc. within a 12-month period—from January 21, 2021, to August 20, 2025—after submitting your cancellation or similar request. (Please note that confirmation of your request does not count.)
According to the dispute resolution website, the lawsuit involves two separate classes of plaintiffs: one for message recipients in Florida and one for the United States as a whole.
How to receive monetary compensation
To receive a cash payment, you must submit a valid application by February 12, 2026. You canapply online if you received a notification of eligibility by mail or email containing a unique identifier and PIN. If you did not receive a notification, you must download and submit a paper application form to the payment administrator. Paper applications must be mailed no later than February 12.
The maximum payout per message is $75, but the final amount may be less depending on the number of claims submitted. Payments may take several months while the settlement details are finalized, so don’t expect immediate payment.
